Getting Custody of Grandchildren
Under Pennsylvania law, a grandparent is able to obtain full custody of a grandchild but only in limited circumstances. If it is in the child's best interests to be in the custody of his or her grandparents and not with his or her parents, then the court may grant custody to a grandparent if:
- The grandparent genuinely cares and is concerned for the child.
- The grandparent's relationship with the child began with parental consent or by court order.
- The grandparent has acted as the child's parent for at least 12 months or when the child is at risk of parental abuse, neglect, alcohol abuse or mental illness.
In addition to meeting these criteria, the court will focus on what is in the child's best interests and that the grandparent's custody will not interfere with the child-parent relationship.
